These Terms & Conditions (“Terms”) govern your access and use of the Rosaleigh website (the “Site”), and the purchase of products from Rosaleigh. By using or ordering from the Site, you agree to be bound by these Terms.

1. Definitions & Interpretation

“We”, “us”, “our”, “Rosaleigh” refers to Rosaleigh, the operator of the Site.

“You”, “your”, “customer”, “consumer” refers to the person placing the order or using our Site.

“Products” means any lingerie, undergarments, sleepwear, or related items sold on the Site.

“Order” means your request to purchase Products via our Site, once accepted by us.

“Website” or “Site” means the Rosaleigh eCommerce platform, including all pages, services, and functionality.

2. Eligibility & Account Registration

You affirm that you are at least 18 years old, or of legal age in your jurisdiction, to form a binding contract.

You agree to provide accurate, complete, and current information when registering an account.

You are responsible for maintaining the confidentiality of your account credentials.

You agree to notify us promptly of any unauthorised use of your account.

3. Products, Descriptions & Availability

We endeavour to display product details, colours, sizes, and descriptions as accurately as possible. Slight variations may occur due to screen settings or manufacturing changes.

We reserve the right to adjust or discontinue Products, change packaging, or update specifications without notice.

If a Product in your Order is unavailable, we will notify you and offer alternatives or a refund.

4. Orders & Contract Formation

Placing an Order does not constitute a binding contract. A contract is formed when we accept your Order by sending you a “Dispatch Confirmation” email.

We reserve the right to refuse or cancel any Order for any reason, including inaccurate pricing, stock unavailability, or suspected fraud.

Prices are shown in British Pounds (GBP) and include 20% VAT, where applicable. We may change prices without notice, but changes will not affect Orders already placed.

5. Payment

Payment must be made using the methods offered at checkout (credit/debit card, PayPal, etc.).

All payments are subject to validation and your bank or provider may impose additional checks or charges.

Your payment is due immediately upon placing your Order unless otherwise agreed.

We do not share your full payment card details — payment processing is handled by secure third-party gateways.

6. Delivery & Risk

We deliver to addresses within the UK only.

Estimated delivery times are communicated at checkout, but are not guaranteed. Delays may occur due to external factors (e.g., courier issues, weather).

Risk in Products passes to you upon dispatch, i.e., when your Order leaves our premises.

You must inspect items on delivery and notify us promptly of any damage, missing items, or defects.

7. Returns & Exchanges

Returned items must comply with the eligibility criteria stated (unworn, unwashed, original tags, etc.).

Rosaleigh reserves the right to reject returns that do not comply.

8. Intellectual Property

All content on the Site (text, images, logos, designs, software) is the property of Rosaleigh or its licensors and is protected by copyright, trademark, and other rights.

You may not use, reproduce, distribute, display, or create derivative works from any content without express written permission from Rosaleigh.

9. Prohibited Uses

Use the Site for unlawful purposes or infringe on third-party rights.
Upload viruses, malware, or malicious code.
Interfere with Site operation, including reverse engineering or scraping.
Impersonate another person or misrepresent your affiliation with Rosaleigh.

The Site and all Products are provided “as is” and “as available.” Except where required by law, we disclaim all warranties, express or implied, including fitness for purpose, merchantability, or non-infringement.

To the fullest extent permitted by law, Rosaleigh’s liability is limited to the amount you paid for the Product. We are not liable for indirect, incidental, or consequential damages.

11. Indemnification

You agree to indemnify, defend, and hold Rosaleigh and its team harmless from any claims, damages, losses, or expenses arising out of your misuse of the Site or Products.

12. Termination

We may suspend or terminate your access at any time for breach of these Terms or suspicious activity.

Termination will not affect rights or liabilities that accrued prior to termination.
